§ 1 Scope and Provider

These General Terms and Conditions apply to all orders placed by consumers through the online shop

hereinafter referred to as "NIVAROQ."

A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to commercial or independent professional activity. The contract is concluded in German. By clicking the checkbox in the shopping cart before placing the order "I have read the general terms and conditions of NIVAROQ," the buyer agrees to these General Terms and Conditions and is bound by them.



§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding contract but only an informal online catalog. Simply placing products in the "shopping cart" does not count as a binding order. A binding order for the products in the shopping cart is only placed by clicking the "Order now with payment" button on the order page. We will then promptly send you a contract confirmation by email, upon receipt of which the contract is concluded.

 

§ 3 Prices and Shipping Costs

§ 3.1 The prices listed on the product page include the statutory VAT and other price components and are understood to be in Swiss Francs (CHF). Promotional offers in our shop may be limited in time or quantity. Details can be found in the product description.

§ 3.2 For delivery within Switzerland/Liechtenstein, we charge a flat rate of CHF 5.90 per order. For orders over CHF 99.00, we deliver within Switzerland/Liechtenstein free of charge.

 

§ 4 Delivery Conditions

§ 4.1 Delivery is only made within Switzerland and Liechtenstein via Liechtenstein/Swiss Post or with the Tisa freight forwarder (from 31.5 kg).

§ 4.2 The delivery time is 3-5 business days, unless otherwise stated in the offer.

§ 4.3 If not all ordered products are in stock, NIVAROQ is entitled to make partial deliveries.

§ 4.4 If delivery of the goods fails due to the customer's fault despite three delivery attempts, we may withdraw from the contract NIVAROQ . Any payments made will be refunded immediately.

§ 4.5 If the ordered product is not available because we are not supplied with this product by our supplier through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if applicable, offer you the delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will promptly refund any services already rendered.

 

§ 5 Payment Terms

§ 5.1 Payment is made via PayPal (including the payment option by credit card), PostFinance, or prepayment.

§ 5.2 When choosing the payment method prepayment, we will provide our bank details in the order confirmation. The invoice amount must be transferred to our account within 5 business days.

§ 5.3 Offsetting with unrecognized or not legally established counterclaims of the customer is excluded.

§ 5.4 The customer may only exercise a right of retention if the claims are based on the same contractual relationship.

§ 6 Electronic Delivery of the Invoice by Email

§ 6.1 Approval of Electronic Invoice Delivery: We are authorized to send our invoices electronically to the email address you provide. You waive postal delivery of the invoice.

§ 6.2 Delivery of the Invoice: The customer is responsible on the recipient side to ensure that all electronic invoice deliveries by email are received. the NIVAROQ can be properly delivered to the email address provided by the customer and technical measures such as filter programs or firewalls must be adjusted accordingly. Any automated electronic replies to NIVAROQ (e.g., out-of-office notices) cannot be taken into account and do not prevent valid delivery.

§ 6.3 Email Address: The customer must promptly notify any change of the email address to which invoices are to be sent in writing (text form by email is sufficient) NIVAROQ to be notified. Invoices sent by NIVAROQ sent to the email address last provided by the customer are considered delivered if the customer fails to notify a change of their email address NIVAROQ has not been disclosed.

§ 6.4 Withdrawal: The customer may revoke their consent to receive invoices electronically by email at any time. After receipt and processing of the written revocation (at least in text form, e.g., by email) by NIVAROQ the customer will receive invoices by post in the future at the NIVAROQ last known postal address. The NIVAROQ reserves the right, for important reasons, to independently send the invoice by email to the NIVAROQ to change the last known postal address.

 

§ 7 Retention of Title

The goods remain the property of NIVAROQ. Before ownership is transferred, pledging, security transfer of ownership, processing, or alteration without the consent of NIVAROQ not permitted.

 

§ 8 Right of Withdrawal

§ 8.1 Consumers have a 45-day right of withdrawal.

Cancellation Policy

You have the right to withdraw from this contract within 45 days without giving any reason.
The withdrawal period is 45 days from the day you or a third party named by you, who is not the carrier, took possession of the goods.

inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email).

You can also fill out and submit the sample cancellation form or another clear statement electronically via the contact form on our website. If you use this option, we will promptly send you an email confirmation of receipt of such cancellation.

To meet the cancellation deadline, it is sufficient to send your cancellation notice before the cancellation period expires.



Consequences of cancellation
If you cancel this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day we receive your cancellation notice. We will use the same payment method you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof of having sent the goods back, whichever is earlier.

You must return the goods immediately and in any case no later than fourteen days from the day you inform us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period expires. You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss is due to handling the goods beyond what is necessary to examine their condition, properties, and functioning.

The following right of withdrawal applies only to consumers.

End of the cancellation policy

§ 8.2 Please avoid damage and contamination. Please return the goods preferably in the original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging to avoid claims for damages due to inadequate packaging.

§ 8.3 Please note that the procedures mentioned in paragraph 8.2 are not a prerequisite for the effective exercise of the right of withdrawal.

 

§ 9 Transport Damage

§ 9.1 If goods are delivered with obvious transport damage, please report such defects immediately to the delivery person and contact us as soon as possible.

§ 9.2 Failure to file a complaint or make contact has no consequences for your statutory warranty rights. However, it helps us assert our own claims against the carrier or transport insurance.

 

§ 10 Warranty

§ 10.1 NIVAROQ guarantees by remedying defects. This is done at the choice of NIVAROQ provides supplementary performance, namely remedying a defect (repair) or delivering a defect-free item (replacement delivery).

§ 10.2 If supplementary performance fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer has no right to a price reduction.

§ 10.3 Batteries are consumable goods with limited warranty. Warranty claims are not established, for example, by loss of performance of batteries caused by normal wear or improper use, operation, or storage. Warranty claims regarding battery performance are therefore generally excluded after 12 months.

 

§ 11 Liability

NIVAROQ excludes liability for slightly negligent breaches of contract. The same applies to breaches of contract by vicarious agents and substitutes.

 

§ 12 Jurisdiction and Applicable Law

The contractual relationships between the customer and NIVAROQ is subject to substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.

 

§ 13 Place of Performance

The place of performance for all transactions is the company location.
